New York is the first US state to temporarily restrict the construction of large data centers. Governor Kathy Hochul signed an executive order under which the state will issue no permits for hyperscale data centers, facilities with a capacity of at least 50 megawatts, for up to one year.
The measure comes at a time when tech companies across the US are scrambling to reserve capacity for AI applications. In New York alone, applications are pending for more than 9 gigawatts of data center space, according to information available around the decision. The state aims to use the pause to prevent the energy demand from those facilities from driving up electricity bills for ordinary residents.
The Department of Public Service and the Department of Environmental Conservation have been tasked with developing a new regulatory framework for the sector during the moratorium.
Why Hochul is hitting the brakes
The core of the decision lies in the state's energy balance. Data centers are extraordinarily power-hungry: a single hyperscale facility of 50 megawatts consumes roughly as much electricity as a small city. If dozens of such centers simultaneously seek connection to the New York grid, network costs rise, and with them the rates paid by households and businesses.
Hochul wants to prevent that cost increase and ties the moratorium to a second measure: she is seeking to repeal the sales tax exemption that large-scale data centers in New York currently enjoy. That exemption was originally introduced to attract the sector, but she argues it no longer fits the current scale of investment.
Senator Kirsten Gillibrand praised the decision. Senator Kristen Gonzalez, who had previously introduced related legislation, sees the moratorium as confirmation of the direction she had already been advocating in the legislature. Mitch Jones of the advocacy organization Food & Water Watch also welcomed the measure, particularly in light of its implications for energy consumption and rates.
Opponents fear flight of investment
Not everyone is enthusiastic. The Associated General Contractors of New York State filed an objection. The construction sector sees contracts at risk for as long as the moratorium remains in effect.
Dan Diorio of the Data Center Coalition, a trade association for the sector, argued that the decision will redirect investment and jobs to other states. That argument is not new: similar objections were raised during earlier local restrictions on data centers, such as those in Amsterdam and Dublin. In practice, demand for suitable locations proved large enough to be partially absorbed elsewhere, though that did not remove the local pressure on the electricity grid.
Senator Bernie Sanders of Vermont noted that his own bill for a federal moratorium on AI data centers had previously been dismissed by critics as too radical. Hochul's decision, a Democrat like Sanders, shows that comparable ideas are now considered politically viable at the state level.
What happens during the moratorium
The moratorium lasts up to one year. During that period, the Department of Public Service and the Department of Environmental Conservation will work on rules determining the conditions under which new hyperscale data centers may obtain a permit in the future. These will likely include requirements relating to energy source, grid connection, and cost pass-through to end users.
Existing data centers are not affected by the order; it applies solely to new permit applications. Projects that are already at an advanced stage may fall outside its scope, though no clarity on that point is available based on current information.
The 50-megawatt threshold is particularly relevant for the AI sector: the largest AI training clusters now being built, such as those of major US tech companies, often require hundreds of megawatts or more. Smaller co-location facilities and edge data centers fall outside the moratorium.
Broader context for Europe and the Netherlands
New York's decision aligns with a pattern that is also familiar in Europe. The Netherlands previously restricted the construction of new data centers in the Haarlemmermeer due to space and energy constraints, and Ireland has also limited permit issuance for large data centers near Dublin on several occasions. The debate in New York adds a new element: the explicit link to AI-related energy demand and the protection of household energy rates as a political argument.
For Dutch and European policymakers weighing similar considerations, the New York decision sets a state-level precedent in the US. It demonstrates that moratoriums are considered politically viable outside Europe as well, though the core question remains the same everywhere: how do you allocate scarce grid capacity between large industrial consumers and the rest of society.
